Reselling and Spam Laws

Posted by Soph, 05-07-2001, 08:23 AM
Hi All, Got a legal question here.... Has anyone had any experience in dealing with clients you resold to that starts to spam people? Besides dropping them as a client - what are the liabilities involved that the reseller should be prepared for? Do you (as resellers) have your clients sign some sort of contract specific to spamming violations to pay up on penalty fees? Any other helpful tips? confused: Thanks for the input! Soph:

not a legal opinion) IMO, if you have no spam in your TOS and you keep records that you have notified the reseller not to spam then you should be OK. That said, it still won't stop you from being named in any action. I haven't heard of a host (or anyone for that matter) as yet actually being sued for spam but the way things are going.....
